The Cerro Wire controversy rages on and the most recent court date has been postponed. Originally scheduled for Feb. 12, the court date has been moved to Friday, March 8.
On March 8, oral argument will take place in front of Judge James A. Catterson in Riverhead. At that time, attorneys representing the three involved parties, the Taubman Company, the Town of Oyster Bay and the local civics, will appear in front of Judge Catterson and orally discuss what was originally submitted in their written documents. The judge will have the opportunity to ask questions regarding the record of this case, which includes approximately 5,000 pages of documents.
No new evidence will be presented during this stage of the process as Judge Catterson must review what was presented and decide if the Town of Oyster Bay's decision to reject the Taubman Company's application to build a 850,000 square foot mall in Syosset is supported by substantial evidence.
The oral argument on March 8 is open to the public and residents are able to attend although it will not be run like the public hearings were in the Town of Oyster Bay. Public comment is not permitted and only the lawyers will be able to speak.
