Settlements in lawsuits which have been occupying the Roslyn Village attorney's office for several months have been reached. The first suit has to do with the construction of a faulty retaining wall on the upper parking lot at the Village Hall at 1200 Old Northern Blvd.

Village Attorney John Spellman said the resolution involved several companies that were involved in the construction of the new village hall, which opened in the spring of 1995.

According to Mr. Spellman, both parties have agreed to a settlement that includes replacement of the support wall. Sometime this summer, a construction company will pour concrete for a new wall with support. One of the companies in question is currently going through bankruptcy hearings, which explains any delays.

Another lawsuit concerns a residential house on Verity Lane. The house was constructed about ten feet above local regulations. While the legal matters were being resolved, the construction company failed to complete the exterior of the house, including all site work and landscaping. Now that a settlement has been reached, the owners of the house will be able to obtain a variance for the building. According to Mr. Spellman, the house has been left unfinished for two years, resulting in an eyesore for the neighborhood and complaints from other residents of Verity Lane.

Completion of both settlements were announced at the last village meeting on Feb. 2. In neither case, however, were the exact terms disclosed.

With spring only a few months away, the subject of both indoor and outdoor entertainment at Roslyn restaurants came up at the meeting.

Kevin Durson, proprietor of Chalet Restaurant at 5 Railroad Avenue, asked for, and received a permit to have live music entertainment at his establishment until 11 p.m. for outdoor concerts and until 2 a.m. for indoor shows.

In the past, Roslyn residents have complained about music coming from at least one restaurant on Old Northern Boulevard. Mr. Durson's restaurant is not on Old Northern. At the Feb. 2 meeting, he said that Chalet's Railroad Avenue location is near a 24-hour Seven Eleven store, a Long Island Rail Road station where a diesel train runs through on a consistent basis, and also has a steady stream of buses and fire trucks driving by the establishment.

In all, Mr. Durson said his music, which is played mostly for birthday parties or Bat Mitzvah events, does not present a noise threat to nearby residents, including those living in co-op apartments near the restaurant. Trustee Marshall Bernstein noted that there have been no complaints from residents about the noise level from Chalet during the nine months last year when Mr. Durson had his permit.

Terry Morabito, owner of Friend of A Farmer, also received a permit to play indoor music until 1 a.m. at his establishment at 1350 Old Northern Blvd.

Mr. Morabito said the music would be similar to the shows he had at Friend of A Farmer two years ago. Then, he hosted shows by Dave Mason and Roger McGuinn (of "The Byrds" fame) that were sponsored by Michael Epstein, the former owner of Roslyn's most famous music club, My Father's Place. The shows were seen as the beginning of Mr. Epstein's possible return to Roslyn as a music impresario, a move which has yet to materialize.

In other news, the board of trustees granted a permit for the construction of a three-car garage at a residence at 69 Remsen Avenue that was recently purchased by Sandstone Homes, Inc. The next BOT meeting is Tuesday, Feb. 16 at 8 p.m.
