Last week, WB Partners of Forest Hills received approval from the Roslyn Village Site Review Board to construct 10 single-family residential units on property off Remsen Avenue.

The property will come under the full ownership of WB once it buys the land from its current owners, the Roslyn Public School district.

However, the SRB attached up to 16 conditions on the construction and maintenance of the housing development. Much of it has to do with the maintenance of the housing development, but there are provisions that put restrictions on future homeowners, and one concerning the future of an historic structure currently on the site.

Concerning the tree issue, it was agreed by both WB and the SRB that each deed to a lot in the subdivision shall contain a "covenant setting forth the requirement to maintain the trees upon each lot."

In addition, walls within the area designed "conservation easement" shall not be removed by the developer. The maintenance of such walls will become the responsibility of the eventual lot owner.

There is an historic structure currently located on Subdivision Lot No. 1 of the future development. WB Partners has agreed to pay for the removal of the lot to a location within the Village of Roslyn. The historic structure is an old residential home which, according to village officials, fits the criteria for an historic building. Village officials have tentatively decided to move the home to a dead end street area of Remsen Avenue.

Other maintenance issues have to do with an "island" that WB plans to construct as part of the housing development. WB has agreed to maintain the island by specifically doing any landscaping and irrigation work concerning the island.

In addition, any maintenance failure by WB or "its successor" will entitle the village "to draw against the public improvement bond submitted with reference" to the project.

WB will also pay the village $5,000 to clean up any "wash outs" that may occur as a result of the existence of the subdivision onto public highways.

The conditions will also result in certain restrictions to be placed on the site's new homeowners.

First, there will be a covenant and restriction prohibiting the owner of any of the homesites to perform any construction of decks that will result in an intrusion into certain areas of the subdivision plan, including the conservation easement.

WB will also write up a covenant prohibiting the construction of any fences on the property lines separating the respective homesites.

Other conditions include the revision of the curbing on the road to Belgian block and the confirmation of such a revision by the Roslyn Planning Board.

Finally, the approval of the building plan is subject to submission to the village of a written guarantee "of a financially competent individual...having a net worth of at least $3 million which will assure and guarantee the completion of each...dwelling unit for which a building unit shall have been taken out."

There are several other conditions that were agreed to by both parties but were not available in writing for the Roslyn News at press time.
