It's a quandry. It is actually the bay side of Centre Island Beach, the Soundside Beach is on the other side of the beach. You reach it by going through the tunnel. Still the photo is taken in an area "overlooking Beekman Beach" and the water, although it is Oyster Bay Harbor - actually comes from the Long Island Sound.

Billy Minicozzi called to say it was a man walking on Tobay Beach in Oyster Bay. He is hoping the Giants go all the way to the superbowl and play the Tennesse Titans in January. "I think it will be played in New Orleans," he said. "Happy Labor Day Weekend and I am looking forward to the fall and football."
