The Supreme Court decided not to overturn the decision of the Mineola Village Board of Trustees to deny 14 additional taxi licenses for L.I. Checker Cab of Mineola, which currently holds one license.

The denial by the Supreme Court is the latest decision in an ongoing battle between the cab company and the Village of Mineola. The contention came as a result of the decision in which the village board concluded that the 32 outstanding licenses, the number set by the village as the appropriate amount of cabs to be operating in the village, were still sufficient to meet the public needs. Also, the village board maintained that in light of potential future development proposed by both the village and the Long Island Railroad, impacting upon the Mineola train station area, issuance of additional cab licenses at this juncture were unwarranted.

L.I. Checker Cab of Mineola brought the appeal against the village of Mineola. However, in a decision rendered on August 7, Justice Bruce D. Alpert decided the "petitioner failed to establish that significant changed circumstances had developed with respect to the need for additional tax coverage since the prior application was denied."

In addition, the Supreme Court's decision stated that there was a lack of evidence to warrant a judicial directive compelling the village to issue additional tax licenses above the 32 presently authorized by the village.
