Now we know the Town has made it very clear that they cannot assure us of snow removal from the Lee Place Walkway, in time for our children to get to school, and we know Dr. Brucia has cleared this path, in the past. If Dr. Brucia does not clear the snow this year in time for our children, who will clear the snow from this path? The Town tells us they have no maintenance records of this walkway and we know Dr. Brucia has cleared this path, but will not write down how many times he and the school district has cleared this path. Is this legal or illegal use of school tax payers money?
The rhetorical questions still remain. Massapequa School District officials tell us, for over 30 years, that the Town of Oyster Bay is legally responsible for maintenance of the Lee Place Walkway. Have school employees ever been used, illegally, to maintain Town of Oyster Bay property, i.e. removal of snow on the Lee Place Walkway? As I understand it, Mr. Van Nostrand (our Massapequa school board attorney) indicated in court on Nov. 20, 1996, to a Nassau County judge that the path crossing guard brings the children to the Unqua Rd. crossing guard, thereby, leaving her path post. Dr. Brucia and the Massapequa School Board, please tell us if you support that information. Where does our school attorney get that information? (Who is watching the children on the path, if she leaves the path?) The path crossing guard indicated in her deposition, that this is not true. The above questions, and others, have been written to the Massapequa School Board and hand delivered to Dr. Brucia, on Sept. 22, 1997, with no response. Thirteen months later, these unanswered questions still remain, and need to be answered, in order to clear up this misinformation.
Who is going to clear this path this winter, (before school) if Dr. Brucia doesn't?
Dr. Brucia has assured me that the school district has done nothing wrong, yet, for some reason he will not answer the above questions, and others. The town attorney has clearly indicated, (with a March 1998 letter), they cannot assure us of snow removal because the Town has higher priorities and will not deviate from those priorities because of this dishonest school policy. This has always been low priority and always will be low priority, as streets, roads and commuter parking lots come first. Dr. Brucia has made it very clear that the school district has plenty to gain by clearing this path, with his actions to justify keeping many grammar school children off a school bus. He has showed us that he is the only one who can assure us of snow removal from this path by sending school personnel onto non-school property to prove his point. Because Dr. Brucia and the school board do not reply, with many verbal and written reminders, can we assume that the school district has cleared and (will continue to clear) this path, more than the town has cleared this path? School maintenance personnel have told me, in confidence, that the school district has cleared this path many times, over many years, under Dr. Brucia's orders. Did Dr. Brucia get permission from the school board, before he sent school personnel onto non-school property? If so, from whom? Please Dr. Brucia and the Massapequa School Board, set the record straight, once and for all, and answer my letter from more than one year ago. How far will Mr. Van Nostrand and the school board go to justify, this unfair and dishonest policy? Will this unfair policy cause school children in the McKenna area to use the Massapequa Preserve to get to the Ames school?
Your failure to reply, with many, many verbal and written reminders, demonstrates your disrespect and dishonesty with this issue.
