I live at Brinkerhoff Lane with my wife and our 9 month old daughter. I would like to thank board members Doreen Banks, Anthony D'Urso and Angelo Ferrara for voting 'No' to Kimco's application for a zoning change in the Filene's Shopping center on June 8th. I would also like to thank Phyllis Clark and Joe Vogel for their untiring efforts in opposition of this application. However, it appears that our work is not done. Kimco has reapplied for a zoning change and this time they claim to have addressed the concerns of the residents of Brinkerhoff Lane. In my opinion the new application does not address the concerns of my family and our neighbors.

My family and I have been opposed to this project from the moment it came to our attention last September, and felt a great sense of relief after the application was first denied by the Board of Zoning Appeals (BZA) in February, then by the Town of North Hempstead Board on June 8th. However, our joy was short lived once we discovered Kimco/King Kullen had filed another application for a zoning change and a hearing was scheduled for July 27th.

I was disappointed to hear that Kimco was given the opportunity to present its revised application so soon after its original application was voted down by the board. For almost a year my neighbors and I have repeatedly expressed concern over the proposed location of the building in the southwest portion of the property and the impact it would have on our quality of life. If the application was approved it would have exposed us to noise and air pollution as well as hazardous pest concerns, that would severely affect our quality of life. The potential for a pest problem is of great concern to us.

It is now almost a year later and what do we have to show for our efforts. Kimco's idea of 'addressing the concerns' of the Brinkerhoff Lane residents is to move the footprint of the building 10 feet to the East while maintaining the originally proposed 25 foot buffer zone. As I have expressed in previously published letters, I have never lived adjacent to a 24 hr Supermarket, so I can not speak from experience if this change is sufficient, but common sense tells me our concerns will not be alleviated by simply relocating the building 10 feet to the east.

If Kimco/King Kullen was serious about addressing my neighbors concerns why haven't we received either one of the two flyers that King Kullen has distributed to the residents of Plandome, Munsey Park, Strathmore and Flower Hill. Quite simply, I believe they are attempting to have this case heard without the knowledge of the Terrace Manor residents, and if it were not for our civic association leaders, they probably would have succeeded already. I feel we are fair and reasonable people and are willing to listen the representatives from Kimco/King Kullen , but have not heard from them since the BZA rejected their application in February. If Kimco was truly concerned with the concerns of the Terrace Manor residents it would have met with our local representatives to discuss any concerns the residents might have prior to the design of the building.

My wife and I moved into our new home last August, knowing full well our property abutted a commercial property. This obviously concerned us but our minds were put at ease upon discovering the property was zoned for parking only. I grew up in Manhasset and was familiar with this property and therefore had no reason to believe a commercial structure would be erected in the space. You can only imagine our shock, when we discovered only a few weeks after moving into our new home that a developer was proposing to build directly behind our property in the area zoned for parking.

I feel fortunate to live in a town such as Manhasset. We chose Manhasset because of its strong sense of community. So far we have not been disappointed. We are extremely grateful to everyone who has voiced there opposition to the Kimco/King Kullen propoasl. We only hope the board members continue to value the concerns of the individual over the interest of business and to continue to consider the hardship this proposal will have on our community.
