According to New Hyde Park Village Mayor Warren Tackenberg, the village has received a notice from the Supreme Court of the State of New York that the case to dissolve the Village of New Hyde Park, has been dismissed.

In a Supreme Court-Short Order, Supreme Court Justice Thomas Adams notified those responsible for the suit including: Vincent DeJoseph, Benjamin Bentivenga, Marty and Evelyn Cris, that the case was abandoned.

Mayor Tackenberg, on behalf of the village, commented, "We appreciate the position of the judge. The decision will now allow all of us on the village board, and all other village officials, to concentrate time and energy on providing all the essential services needed for the village to operate as a family."

The Illustrated News contacted Benjamin Bentivenga and Marty and Evelyn Cris and none was aware of the court decision. Bentivenga said that until he receives the word directly from the court, or his attorney, he is unable to comment on the decision or on the comments by the village.
