The village board of the Village of New Hyde Park emphatically denies that it is responsible for the eviction notice apparently served on Audra Radziunas, the proprietor of Babushka's Attic Thrift Shop, located at 1314A Jericho Turnpike.
This denial is in direct response to a sign on the premises in question that states that the Village of New Hyde Park is "kicking her out." It can only be presumed that the eviction notice was served upon her by her landlord.
In a letter dated Sept. 10, Village Building Inspector Sam Horowitz supplied her the following information:
"Dear Audra Radziunas:
"With reference to the sign in your window, 'Village of New Hyde Park Kicking Us Out,' please be advised that the village is neither evicting you, 'kicking you out,' nor has it sought your eviction.
"For your information, your landlord was required to install a sprinkler system by state law, under the New York State Uniform Fire Prevention and Building Code. The determination that this was a requirement for the class of tenancy for which the building was being used was made in July, 1997.
"The options available to the landlord were to either install the sprinkler system, appeal to the State of New York for a variance to the state building code, or remove the class of tenancy. The landlord chose to pass the requirement for the sprinkler system on to the tenant (Babushka's Attic Thrift Shop,) in Aug. 1998, via the lease.
"This being said, it would appear that the eviction notice was a result of a difference between you and your landlord, and not a result of a demand by the village.
"We request that you remove the sign. It is incorrect and very misleading. This village and its administration are very active in promoting the business community, and we are offended by an implication that we want to evict valuable members of that community."
For Ms. Radziunas to continue her operations while creating the impression that the village is 'kicking her out' does a great disservice to both the village and the truth of the issue.
