The Nassau County Special Victims Squad, through a joint investigation with Garden City detectives, arrested a 19-year-old male from Staten Island Aug. 9 in connection with a rape that allegedly occurred in an Adelphi University dorm room back in February.
According to Special Victims Squad Detective Trujillo and Garden City Detective Braun, on the night of Feb. 4, 2006 into the morning of Feb. 5, 2006, a group of Adelphi University students were attending an off-campus party. Upon returning to campus, the 19-year-old female victim, the 19-year-old male defendant and a few other students allegedly continued the party in the defendant's dorm room.
At some point the victim passed out on the defendant's bed, according to police, and all the other students left the room. It is alleged that the victim then woke up a short time later to find the defendant allegedly engaged in sexual intercourse with her. She was able to push the defendant off her and run from the room, police said.
On Wednesday, April 19, 2006, the victim reported the incident to police and the Nassau County Special Victims Squad conducted an investigation, which led to the Aug. 9 arrest. At that time, the defendant, Kevin Lin, surrendered to police and was charged with first-degree rape. He was slated for arraignment in First District Court in Hempstead Aug. 9.
Immediately upon learning of the incident, Adelphi University took action in accordance with federal regulations. Lin was suspended on an interim basis and barred from campus, while further investigation was undertaken. The victim was offered counseling services and was advised to notify police authorities, but at first chose not to.
In a sexual assault case, Adelphi University practice is to make the victim aware of one's options, encourage the victim to make a report with the police and assist the individual in doing so. Due to the nature of the incident, and in the interest of protecting the victim's privacy, University policy, in compliance with the federal Campus Sexual Assault Victims' Bill of Rights, is to follow the victim's wishes about reporting the alleged crime to the police.
Adelphi University immediately convened a hearing on the incident, and based on its findings formally suspended Lin and barred him from all Adelphi campuses.
Adelphi officials note that the University has an excellent and longstanding working relationship with the Garden City and Nassau County police departments and the Nassau County District Attorney's office and are fully cooperating with police in their investigation of this matter.
Officials further noted that the University annually publishes its public safety report and remains committed to protecting the safety of all of its students and ensuring that the campus remains one of the safest in the country.
